In his 2004 decision, the Board sustained an appeal by the Registrant to suspend telemarketing on the ground that the mark had attained incontestability. In substance, the Board found that the Cons to examiner had made a few formal findings and sustained the Opposition for reasons, inter alia, of abandonment based on the lack of evidence that the Cons had been used after 1980.
